- BINDING AGREEMENT AND SCOPEWelcome to the Washables website (the “Site”). These Website Terms of Use govern your access to and use of the Site, including any content, functionality, and services offered on or through the Site, whether as a guest or a registered user. By using the Site, you accept and agree to be bound and abide by these Terms of Use and our Privacy Policy. If you do not want to agree to these Terms of Use, you must not access or use the Site. These terms apply strictly to the digital interaction with the Company and are intended to be read in conjunction with our Customer Terms and Conditions and User Agreement.
- ACCESSING THE SITE AND ACCOUNT SECURITYWe reserve the right to withdraw or amend this Site, and any service or material we provide on the Site, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Site is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Site, or the entire Site, to users, including registered users. - ONLINE ORDERING AND SERVICE BOOKINGThe Site provides functionality for customers to book laundry pickups, schedule recurring services, and manage garment care preferences. When you place an order through the Site, you are making an offer to purchase services which, if accepted by us, will result in a binding contract. We reserve the right to refuse or cancel any order at our sole discretion, including for reasons such as service area limitations, incorrect pricing displayed on the Site due to technical error, or suspicion of fraudulent activity. You are responsible for ensuring the accuracy of the pickup address, contact information, and specific garment instructions entered into the online forms. Washables is not liable for service failures resulting from inaccurate data entry by the user.
- INTELLECTUAL PROPERTY RIGHTSThe Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Washables, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. These Terms of Use permit you to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as it is incidental to your web browser or device temporarily storing copies of those materials for purposes of accessing and viewing them. You must not use any illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.
- TRADEMARKSThe Company name, the term “Washables,” the Company logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Washables or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.
- PROHIBITED USES AND ACCEPTABLE USE POLICYYou may use the Site only for lawful purposes and in accordance with these Terms of Use. You agree not to use the Site in any way that violates any applicable federal, state, local, or international law or regulation. - INDEMNIFICATIONYou agree to defend, indemnify, and hold harmless Washables, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of the Site, including, but not limited to, your User Contributions, any use of the Site’s content, services, and products other than as expressly authorized in these Terms of Use, or your use of any information obtained from the Site.
- TERMINATIONWe reserve the right, without notice and in our sole discretion, to terminate your account or your use of the Site, and to block or prevent future access to and use of the Site if you violate these Terms of Use. Upon termination, any rights and licenses granted to you hereunder will automatically terminate.
- GOVERNING LAW AND JURISDICTIONAll matters relating to the Site and these Terms of Use, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the state where Washables is headquartered, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Site shall be instituted exclusively in the federal courts of the United States or the courts of said state.
- ENTIRE AGREEMENTThe Terms of Use, our Privacy Policy, and our Customer Terms and Conditions and User Agreement constitute the sole and entire agreement between you and Washables regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
